Special counsel Robert Mueller's team is dismissing claims from Michael Flynn's attorneys that Flynn lied to the FBI because the agents who interviewed him acted improperly. Specifically, Flynn claims that during a meeting in January 2017 agents didn't warn him that lying to the FBI is a crime. The former National Security Adviser also alleges then-FBI Deputy Director Andrew McCabe recommended he not have an attorney present during the meeting. 

In a court document filed Friday, Mueller responded by saying "nothing about the way the interview" on January 24 "was arranged or conducted caused," Flynn to lie. Mueller also said Flynn "chose to make false statements about his communications with the Russian ambassador weeks before," the interview.

Despite this, Mueller's office says it still believes Flynn should "receive a sentence at the low end of the guideline range." That's because, Mueller says, he's accepted responsibility for his actions, has cooperated with investigators and because of his military service.

Flynn is set to be sentenced on December 18.
