Matt MorenoNASCAR driver Tony Stewart won't face any criminal charges after a grand jury decided not charge him with second-degree manslaughter or criminally negligent homicide.
ONTARIO COUNTY (N.Y.) DISTRICT ATTORNEY MICHAEL TANTILLO VIA FOX SPORTS: "After listening to and questioning all the witnesses and reviewing all the evidence, the grand jury has determined that there is no basis to charge Tony Stewart with any crimes."
The incident in question, which happened back in August, occurred at a New York-area racetrack. Driver Kevin Ward Jr. can be seen getting out of his crashed car, going toward Stewart's moving car. Stewart's car can then be seen hitting Ward. Ward died from the accident. (Video via YouTube / Law Offices of John M. Phillips)
District Attorney Michael Tantillo also said Ward tested positive for marijuana with levels high enough to impair his judgement. Tantillo said the grand jury wasn't looking at whether anyone else, aside from Stewart, was at fault.
TANTILLO VIA ESPN / WHAM: "I am sure, based on their deliberations and discussions, that the fact that Kevin Ward was observed running basically two-thirds of the track, into a hot track ... played a big, big factor in their decision."
Stewart voluntarily sat out of racing for three weeks following the incident.
STEWART VIA USA TODAY / WXIA: "This is a sadness and a pain that I hope no one has to ever experience in their life."
He finally returned Aug. 30, racing in the Oral-B USA 500 at Atlanta.
Stewart is next scheduled to race this Sunday at Dover International Speedway.
